TERMS AND CONDITIONS – Photogift.eu

All orders placed with Photogift.eu are subject to the terms and conditions below. By placing an order, the customer confirms acceptance of these terms. The customer declares to be of legal age or – in the case of minors – to have obtained permission from a parent or legal guardian.


1. Intellectual Property & Indemnification

The customer guarantees that they hold all necessary copyrights and usage rights for the uploaded image files. B&Vmedia BV is not liable for any third-party claims related to copyright infringement.
The customer agrees to indemnify B&Vmedia BV against all claims related to the content they provide.
Submitted files are used exclusively for the agreed-upon order and will not be used for any other purpose – digital or printed – without the customer’s explicit written consent.


2. Delivery Times & Delays

Delivery times listed on the website are average estimates and non-binding. Delays do not entitle the customer to compensation, cancellation, or any other form of claim, unless the order has not been delivered within 30 days of purchase. In such a case, the consumer may cancel the agreement free of charge in accordance with Article VI.43 of the Belgian Economic Law Code.
For rush orders with an extra fee (30% surcharge, min. € 4.99), the fee may be refunded if delivery is late and no force majeure applies.

3. Cancelling Orders

Orders are placed into production immediately after payment. Cancellation or modification is not possible after payment has been completed.


4. Rejection of Submitted Content

Photogift.eu reserves the right to reject images that are deemed pornographic, hateful, discriminatory, or otherwise socially inappropriate. In serious cases, a report may be filed with the relevant authorities.


5. Discounts & Gift Vouchers

  • Only the highest available discount applies; discounts cannot be combined.

  • Forgotten discount codes cannot be applied retroactively.

  • Promo codes and gift vouchers are not redeemable for cash.

  • If a code was forgotten but payment not yet completed, the order can be placed again.

  • If payment has already been made, a voucher equal to the missed discount may be provided upon request.

  • Vouchers are not valid on photo books, calendars, or greeting cards.


6. Warranty, Complaints & Right of Withdrawal

All products are covered by the standard two-year legal warranty for consumers under EU law.

Complaints Procedure

For any verifiable damage or production defects, we offer a “money-back guarantee.” Do not return any product without first contacting us.
Complaints must be submitted via info@photogift.eu along with the order number, description of the issue, and clear photos.
After review, a return request may be issued. If the claim is validated, return shipping costs will also be reimbursed.
Complaints about damage or incomplete deliveries should preferably be submitted within 2 working days and no later than 2 months after delivery. Submissions outside this window may not be processed.

Colour Deviations

Complaints regarding colour (including sepia or black & white) are accepted only if the delivered item clearly deviates from a previously approved proof. Colour proofs can be requested at cost via info@photogift.eu.

Right of Withdrawal

There is no right of withdrawal for personalised products (e.g. photo prints), in accordance with Article VI.53, 3° of the Belgian Economic Law Code and Article 16(c) of Directive 2011/83/EU.
For non-personalised products (e.g. frames, hanging systems, wooden stands, or easels), the statutory 14-day right of withdrawal applies.

The withdrawal period begins on the day the product is received by the customer or a third party (not the carrier).
Withdrawal must be declared in writing via info@photogift.eu or by post.
Following confirmation of withdrawal, the full purchase price (including standard shipping costs) will be refunded within 14 days using the original payment method.
Products must be returned within 14 days of withdrawal notice.
Return shipping costs will be covered by Photogift.eu.
Customers are only liable for diminished value due to use beyond what is necessary to determine the nature and characteristics of the item.

This withdrawal policy does not affect the consumer’s statutory rights.


7. Order Processing

Orders are processed based on files uploaded and/or edited by the customer. Once payment has been completed, the order is considered final and cannot be changed.
For orders submitted via email or WeTransfer and processed by Photogift, the auto-generated PDF invoice serves as order confirmation.
For business customers with post-payment agreements, the customer is responsible for verifying the invoice. If no objection is raised within one working day of receipt, the order is deemed accepted.


8. Online Dispute Resolution (ODR)

The European Commission provides a platform for online dispute resolution:
